These terms apply to this website and to the Bana Systems Inc. platform. By using either you agree to them. They are deliberately short. Where a subscription agreement with a contractor says something different, that agreement wins for that contractor.

The website

You may use this website to learn about the platform and to send us an inquiry. Do not submit information about anyone other than yourself or your company, do not submit the form by automated means, and do not attempt to interfere with the site or the systems behind it.

The platform

Accounts

A contractor subscribes to the platform and creates accounts for its team; a contractor's customers use the portal and tools the contractor makes available to them. You are responsible for what is done under your account and for keeping your sign-in details to yourself. Tell us at once if you believe an account has been used without permission.

Measurements, estimates and reports

Roof measurements are derived from aerial and satellite imagery and from the edits a contractor's team makes to them. They are an aid to estimating, not a survey, and they can be wrong where the imagery is old, obscured or misaligned. An instant estimate is a preliminary price range produced automatically from a measurement and a contractor's own catalogue; it is marked preliminary on the document itself and is not an offer to do work at that price. A formal estimate is issued by the contractor, from the contractor, and is the contractor's document. Bana Systems is not a party to any contract between a contractor and its customer.

Your data

Contractors own the information they and their customers put into the platform. We hold it to provide the service, as described in our privacy policy, and we keep each contractor's data separate from every other's. We do not sell it and we do not use it for our own marketing.

Acceptable use

Do not use the platform to send messages to people who have not asked for them, to enter addresses or details of people you have no business relationship with, to probe or overload our systems, or to do anything unlawful. We may suspend an account that does.

Email from the platform

The platform sends email only in response to an action: a verification code, an estimate you ran, or a report your contractor sent you. There is nothing to unsubscribe from because there is no subscription. If you receive a message you did not expect, reply to it and a person will look into it.

Availability and changes

We aim to keep the platform available and we will tell subscribers ahead of planned interruptions, but we do not promise uninterrupted service. We improve the platform continuously and may change or withdraw features; where a change removes something a subscriber relies on we will say so in advance.

Fees

Subscription fees are billed in advance at the start of each monthly or annual period. Per-report and per-estimate charges are billed in arrears for the period in which they were used. Prices may change with at least 30 days' notice, taking effect at the start of the next billing period. Fees are not refunded for a partial period unless the law requires it.

Liability

To the extent the law allows, we are not liable for loss arising from reliance on a measurement, an instant estimate or a report without independent verification, or for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.

Ending

A contractor may close its account at any time. We may close an account for a serious or repeated breach of these terms. Data is handled after closure as the privacy policy describes.

Governing law

These terms are governed by the laws of the State of California, United States, and any dispute is brought in the courts of California.
